Experts of the publication Avtovzglyad explained to motorists what to do in order to get directions from insurers for repairing a damaged car. According to them, often employees of insurance companies insist on monetary compensation, the size of which is reduced due to depreciation of the car.
Experienced drivers claim that the so-called wear of components and parts of a car sometimes allows insurers to halve the amount of monetary compensation. Given that repairing a damaged car is much more expensive for the company, its specialists are forcing the client to receive money instead of fixing the car.
Experts note that, according to Russian law, car insurance under compulsory motor liability insurance is considered a priority way to recover damages. Money is paid to the insured only at his request or if the car cannot be restored after an accident.
The driver, to whom monetary compensation was accrued without his consent, has the right to apply to the court. Moreover, in the event of a positive outcome of events, it is possible to achieve not only a referral for repairs, but also receive compensation in the amount of 1% of the amount of insurance compensation for each day of delay in the provision of services. In addition, in most cases, the courts oblige the insurance companies to pay the client a fine of 50% of the compensation due to the motorist for untimely fulfillment of their obligations.
